Please join Utah CFMA for a fun and informative time in a Bees Game Suite on Thursday, June 8th. We have a club-level suite reserved for a presentation by Andrew Berne of Babcock Scott & Babcock who will discuss "Construction Claims Checklist." This educational & networking event about legal issues in the construction industry is one not to be missed. Stay for food and beverages, and watch the Bees game against the Round Rock Express at 6:35pm. 

 

This event is free to chapter members, but it has a limited number for attendance and you must pre-register. Each member may register one guest; guests must be registered with a separate email address on the event registration page. Use your same log-in information, just enter a new email address. After May 24, we will offer remaining tickets to additional members' guests. 

 

Attendance is first-come first-served so be sure to sign up early. Sign up will close on Friday, June 2 at 5pm. 

One hour of Non-Technical CPE credit will be offered.

Andrew Berne

With a general contractor grandfather and an attorney father, construction litigation seemed like the natural choice. I studied construction management and use my degree and experience I gained building homes to effectively and efficiently identify key issues in resolving construction disputes. 

While my primary focus is construction litigation, many disputes can be avoided through careful review of the construction contract. Many clients have had to learn through the school of hard knocks the value of reviewing their contracts. While a simple handshake may be binding, a well thought out and negotiated contract helps avoid the leading cause of construction disputes, differing expectations, where the contractor’s understanding of the contract requirements differs from the owner’s. 

A common pitfall in the construction industry is waiting too long to seek help. In such cases they have often already missed vital deadlines to preserve lien or bond claims, waived claims or defenses that could otherwise have been asserted, or made other mistakes.
